Lawsuit against Palmer Lake dismissed

On Friday, Oct. 3, El Paso County District Court Judge William B. Bain dismissed a lawsuit brought in January against the Town of Palmer Lake by Integrity Matters.

The suit sought to stop the development of a proposed Buc-ee’s travel center. Integrity Matters claimed that the actions taken by the town in determining annexation eligibility were “arbitrary, lacked transparency, and ignored critical statutory and constitutional safeguards.”

The board voted 4-1 in December and 6-1 in May that the land west of Interstate 25 and north of Monument was eligible to apply for annexation.

In dismissing the lawsuit, the judge found the plaintiffs lacked standing to contest the annexation and had insufficient legal grounds for their other complaints.

In a press release, the town said, “The Court’s ruling confirms that the claims brought against the Town were without sufficient legal basis to move forward. While the order itself is concise, it firmly upholds the
key arguments the Town presented and provides a solid foundation should an appeal be pursued.”

Palmer Lake Trustee Amy Hutson resigns

Here is her Oct. 3 message as posted on the PL website:

To the residents of Palmer Lake:

I have volunteered for 5 years for the Town of Palmer Lake as both a Planning Commissioner and then as Trustee. During that time, I have helped write and implement the current Community Master Plan, rewrite the sign code, rewrite the land use code, push for a code compliance officer, and push for a real plan for the Elephant Rock property. I became a trustee to honor the master plan and the planning commission. I was always trying to help and make things better.

I have been yelled at, defamed, accused of wrongdoing, and sued. Breaking news….The judge has dismissed all charges against me and all the other charges against the town. “Integrity” Matters is a joke. Look it up. Look up also that they tried to get the town to pay $775,000 to settle.

My skin is too thin and I’m too bitter at this point to carry out my office. I officially resign my position as a Palmer Lake Trustee as of today October 3rd , 2025. And by the way, if BOT did get to vote on Buc-ee’s, I was going to vote No. Good luck finding someone who knows the master plan and code as well as I do who has a kind servant’s heart.

Palmer Lake Board grants Buc-ee’s request for annexation election, continues public hearing to Feb. 5

At the special meeting Oct. 2, the Palmer Lake Board of Trustees planned to hold a public hearing on the Buc-ee’s annexation to consider the petition for annexation, a plan to zone the property as Planned Development (PD), and a sketch plan. A large audience attended and vocally expressed their disapproval with the proceedings.

The agenda noted that the applicant submitted a written request to hold an annexation election and continue the public hearing to a later date and specify the date of that hearing. Town Attorney Scott Krob, noting the recently passed ordinance used the vague language of the initiative that voters passed in the Sept. 9 special election, said that the applicant was within their rights to request the election and the board should follow the will of the voters. At the Sept. 25 board meeting, Krob said the election could take place at any point in the process. Krob said the board’s election consultant said the election could take place within 120 days and that, given their reimbursement agreement with the applicant, Buc-ee’s would pay for the cost of the election.

After much discussion from the board and numerous points of order and points of information, primarily raised by Integrity Matters’ attorney Kat Gayle, the board voted four in favor and three opposed to granting the request for an annexation election and to continue the public hearing until February 5. Trustees Beth Harris, Atis Jurka, and Roger Mosely voted no; Mike Boyett, Tim Caves, Amy Hutson, and Mayor Dennis Stern voted yes.

Had the board voted on the questions in the originally planned public hearing, a two-thirds vote would have been required in accordance with Section 17.14.010 (7) of the town’s municipal code because the proposed rezoning had been protested by more than 20% of the owners of adjacent properties.

To the residents of Palmer Lake:

I have volunteered for 5 years for the Town of Palmer Lake as both a Planning Commissioner and then as Trustee. During that time, I have helped write and implement the current Community Master Plan, rewrite the sign code, rewrite the land use code, push for a code compliance officer, and push for a real plan for the Elephant Rock property. I became a trustee to honor the master plan and the planning commission. I was always trying to help and make things better.

I have been yelled at, defamed, accused of wrongdoing, and sued. Breaking news….The judge has dismissed all charges against me and all the other charges against the town. “Integrity” Matters is a joke. Look it up. Look up also that they tried to get the town to pay $775,000 to settle.

My skin is too thin and I’m too bitter at this point to carry out my office. I officially resign my position as a Palmer Lake Trustee as of today October 3rd , 2025. And by the way, if BOT did get to vote on Buc-ee’s, I was going to vote No. Good luck finding someone who knows the master plan and code as well as I do who has a kind servant’s heart.

Palmer Lake Board grants Buc-ee’s request for annexation election, continues public hearing to Feb. 5

At the special meeting Oct. 2, the Palmer Lake Board of Trustees planned to hold a public hearing on the Buc-ee’s annexation to consider the petition for annexation, a plan to zone the property as Planned Development (PD), and a sketch plan. A large audience attended and vocally expressed their disapproval with the proceedings.

The agenda noted that the applicant submitted a written request to hold an annexation election and continue the public hearing to a later date and specify the date of that hearing. Town Attorney Scott Krob, noting the recently passed ordinance used the vague language of the initiative that voters passed in the Sept. 9 special election, said that the applicant was within their rights to request the election and the board should follow the will of the voters. At the Sept. 25 board meeting, Krob said the election could take place at any point in the process. Krob said the board’s election consultant said the election could take place within 120 days and that, given their reimbursement agreement with the applicant, Buc-ee’s would pay for the cost of the election.

After much discussion from the board and numerous points of order and points of information, primarily raised by Integrity Matters’ attorney Kat Gayle, the board voted four in favor and three opposed to granting the request for an annexation election and to continue the public hearing until February 5. Trustees Beth Harris, Atis Jurka, and Roger Mosely voted no; Mike Boyett, Tim Caves, Amy Hutson, and Mayor Dennis Stern voted yes.

Had the board voted on the questions in the originally planned public hearing, a two-thirds vote would have been required in accordance with Section 17.14.010 (7) of the town’s municipal code because the proposed rezoning had been protested by more than 20% of the owners of adjacent properties.

Palmer Lake Commission Recommends Denial of Buc-ee’s Plans

At its Sept. 2 special meeting, the Palmer Lake Planning Commission voted to recommend denial of Buc-ee’s Planned Development Plan (PD), sketch plan, and annexation agreement.

Commissioner Andre Bergeron recused himself, citing an intimidating package delivered to his home that alarmed his family and compromised his impartiality.

Town Attorney Scott Krob said the meeting continued the Aug. 20 session and would focus on the applicant’s responses to prior questions. Public comment remained closed, but Chair Charlie Ihlenfeld allowed a brief recess to distribute printed Q&A documents.

After a failed motion to approve the PD with conditions, Commissioner Bill Fisher moved to recommend denial, citing noncompliance with the Community Master Plan, excessive size, loss of small-town character, amount of impermeable surfaces, water concerns, night sky impact, and lack of bike and pedestrian infrastructure. The motion passed 3–2.

The commission voted 3–2 to recommend denial of the sketch plan on similar grounds.

Commissioner Matt Stephen led the annexation agreement discussion, citing vague language about building size and unclear responsibility for County Line Road improvements. Beeson raised concerns about long-term water needs. The motion to deny passed 4–1.

The Board of Trustees will make the final decision at its Oct. 2 special meeting.

Palmer Lake Planning Commission Delays Buc-ee’s Annexation Vote

After a six-hour meeting Aug. 20 attended by more than 100 people, the Palmer Lake Planning Commission voted to postpone its recommendation on the proposed Buc-ee’s annexation . The commission heard a presentation by the applicant on the annexation, a Planned Development Plan, and a subdivision sketch plan. Public comments were overwhelmingly opposed, with only two speakers supporting the project. Town Attorney Scott Krob addressed concerns about Commission Chair Charlie Ihlenfeld’s public support for the annexation, clarifying that the matter is legislative, not quasi-judicial and Ihlenfeld is entitled to speak on the matter.

Todd Messenger, attorney for United Congregational Church, said a competing annexation petition filed Aug. 18 takes precedence and halts further action on Buc-ee’s. Commissioners cited the late delivery of an 844-page packet and a revised annexation agreement as reasons for the delay. A motion to continue the meeting until Aug. 27 failed in a tie vote. The commission unanimously agreed to submit questions to the applicant by Aug. 27, with responses due Sept. 1 and convene a special meeting Sep. 3.

Gleneagle News Donala Water & Sanitation District’s General Manager Jeff Hodge put on administrative leave

A special meeting was held Aug. 22 to address the topic. The agenda and board packet including a draft resolution authorizing an investigation into complaints about workplace culture and leadership are posted at https://www.donalawater.org/2025-08-22-board-meeting. Palmer Lake News – Mike Boyett appointed to Board of Trustees

At the August 6 workshop and special meeting of the Palmer Lake Board of Trustees, the board filled the vacancy created when Dennis Stern stepped down to be appointed mayor. The board held its final interview with Planning Commission member Michael Beeson who spoke of his background on the commission and in military leadership. Board member Atis Jurka nominated Beeson to be appointed but the tie vote of 3-3 did not pass. Board member Kevin Dreher nominated Mike Boyett, former waste plan operator at the Upper Monument Creek Regional Wastewater Treatment Facility who was approved on a 4-2 vote. The board voted unanimously to pass resolution 50-2025 to appoint Boyett to the trustee vacancy and he was sworn in by Town Clerk Erica Romero.

Palmer Lake News – Mike Boyett appointed to Board of Trustees

At the August 6 workshop and special meeting of the Palmer Lake Board of Trustees, the board filled the vacancy created when Dennis Stern stepped down to be appointed mayor. The board held its final interview with Planning Commission member Michael Beeson who spoke of his background on the commission and in military leadership. Board member Atis Jurka nominated Beeson to be appointed but the tie vote of 3-3 did not pass. Board member Kevin Dreher nominated Mike Boyett, former waste plan operator at the Upper Monument Creek Regional Wastewater Treatment Facility who was approved on a 4-2 vote. The board voted unanimously to pass resolution 50-2025 to appoint Boyett to the trustee vacancy and he was sworn in by Town Clerk Erica Romero. Pictured below (L to R): Romero and Boyett. Palmer Lake News – Mike Boyett appointed to Board of Trustees

Stern appointed Palmer Lake Mayor

The Town of Palmer Lake released the following statement: “After discussion about filling the Mayor’s vacancy, the Board of Trustees accepted the resignation of Trustee Stern and voted to appoint former Mayor Pro Tem Dennis Stern to the office of Mayor. The oath of office was administered on June 12, 2025.”

Palmer Lake Mayor Havenar resigns

After our June 7th issue had gone to press, it was announced in a June 5th press release that Glant Havenar has resigned as Mayor of the Town of Palmer Lake.

The resignation comes following text messages being made public in which Havenar insulted constituents, fellow board members, and community residents and admitted to creating fake social media accounts and communicating with Darcy Schoening and Buc-ee’s consultant Mark Waller during meetings. Buc-ee’s has proposed building a travel center at the southwest corner of I-25 and County Line Road. Some texts were shared widely on social media, excerpted from a supplemental filing to a lawsuit filed by Integrity Matters against the Town of Palmer Lake.

Legacy at Jackson Landing Community Meeting, June 19

A community meeting will be held Thursday, June 19, 5:30-6:30 pm at the Tri-Lakes Chamber Meeting House, 300 Highway 105 in Monument 80132.

Legacy at Jackson Landing is 30-acre commercial development which includes a 129,000 square foot “major” retailer, a potential hotel, restaurants, and additional retail space. It is located next to I-25, just north of Baptist Road.  For more information on the project, see the Monument Planning Commission Article in our June 7th issue: wp.ocn.me/v25n6monpc/ and attend the community meeting June 19.

As announced on the front page of our May 3rd issue, Our Community News has launched two new podcast series designed to help busy commuters, multitaskers, and anyone who loves staying informed and engaged.
